No rulings at Hennis hearing

FORT BRAGG, N.C. — Prosecutors and defense lawyers argued over access to information at a hearing in the case of an Army master sergeant recalled to duty to be tried a third time on murder charges.

The Fayetteville Observer reported Tuesday a judge didn’t issue a ruling and set another hearing for March 31. The court-martial of 50-year-old Master Sgt. Timothy B. Hennis is scheduled to start in July.

Hennis was recalled to duty in 2006, after a new analysis of DNA evidence, so he could be charged in the 1985 slayings of 31-year-old Kathryn Eastburn and her two young daughters.

His initial conviction and death sentence in civilian state court for those deaths had been overturned on appeal, while a second jury acquitted him.
